SkoolNet 2 Terms of Use

  1. SkoolNet 2 is owned and operated by NTUC First Campus Limited (“NFC”).
  2. SkoolNet 2 is a free service offered to all parents (and certain authorised persons of such parents) of children who are currently enrolled in  preschool centres operated by the NFC group (including My First Skool and The Little Skool-House).
  3. SkoolNet 2 is a one-stop preschool management system that connects parents and authorised persons, and staff across the NFC network. SkoolNet 2 allows parents and authorised persons (subject to these Terms) to have access to information and services provided by NFC to support their children in their preschool journey.
  4. Before you may be given access to your SkoolNet 2 account, you must agree to be bound by these Terms, including NFC’s Personal Data Protection Policy found at www.ntucfirstcampus.com/privacy-policy, which is incorporated herein by reference.
  5. NFC reserves the right, at its absolute discretion, to revise these Terms at any time. All revisions to these Terms will be posted on SkoolNet 2, and your access or use of your SkoolNet 2 account after such revision has been posted shall constitute your agreement to the revised Terms.
  6. In these Terms, any reference to:
  1. access” or “use” in respect of your SkoolNet 2 account shall include access to SkoolNet 2, and the access or use of any content or services available on SkoolNet 2, regardless of whether such access or use is through a website, a mobile application or otherwise;
  2. authorised person” means any person who is not a parent of the child, and has been authorised by the child’s parent to pick up the child from the child’s preschool centre;
  3. parent” includes a person who has been appointed as a testamentary guardian, a legal guardian under the Guardianship of Infants Act 1934 or any other applicable laws, or a legal guardian appointed by a court of competent jurisdiction;
  4. parent app” means the tool for parents to access child’s details & daily progress, and other features available within the tool;
  5. preschool centre” means NFC’s preschool centre in which the child is currently enrolled;
  6. SkoolNet 2 User” means a person for whom a SkoolNet 2 account has been created;
  7. we”, “us” or “our” refer to NFC;
  8. you” or “your” refer to the relevant SkoolNet 2 User (as defined above).

1. SkoolNet 2 Account Registration, Setup, Access, and Termination

1.1 NFC will create SkoolNet 2 accounts for parents upon their child’s successful enrolment at a preschool centre. Subject to these Terms, a parent may appoint an authorised person for their child and create a SkoolNet2 account for such authorised person through the SkoolNet2 Parent App.

1.2 NFC will provide details such as a unique username and default password to facilitate each SkoolNet 2 User’s first-time access to his/her SkoolNet 2 account.

1.3 Each SkoolNet 2 User is responsible for changing the default password provided by NFC and maintaining the confidentiality of his/her SkoolNet 2 account details (including password), to prevent unauthorised access and use of his/her SkoolNet 2 account.

1.4 NFC reserves the right, at its absolute discretion, to grant to or deny any SkoolNet 2 User or limit any SkoolNet 2 User’s access to any content or services available on SkoolNet 2, in view of the following considerations:

  1. the SkoolNet 2 User’s relationship to the child (such as whether the SkoolNet 2 User is the child’s parent, or an authorised person) based on NFC’s records;
  2. in respect of an authorised person, whether the child’s parent has informed NFC that you shall be appointed as or cease to be an authorised person or that certain content or services shall or shall not be made available to you; 
  3. NFC’s compliance with any law, regulation, or court order (a copy of which has been duly provided to NFC); 
  4. any other information that NFC considers relevant,

    at any time without notice, and without liability to you.

1.5 NFC reserves the right, at its absolute discretion, to do any of the following:

  1. discontinue or decommission SkoolNet 2, suspend or terminate your SkoolNet 2 account, or otherwise deny you access to SkoolNet 2 or your SkoolNet 2 account;
  2. update or create new versions of SkoolNet 2;
  3. add, modify or delete any content or services that forms part of SkoolNet 2, 

    at any time without notice, for any reason, and without liability to you.

1.6. NFC will permanently deactivate your SkoolNet 2 account, with effect from the date of your child’s withdrawal or graduation from the preschool centre.

2. Authorisation for Authorised Persons to Use SkoolNet 2 to Pick Up Child from Preschool Centre

2.1 Parents understand and agree that your child may be released to any person whom you have listed as an authorised person through your SkoolNet 2 Parent App and that such authorised person will have access to his/her own SkoolNet 2 account to use the “child check-out” service to pick up your child from the preschool centre.

2.2 Parents further understand and agree that NFC shall not be held responsible for any incident or accident that may occur after an authorised person has picked up your child from the preschool centre.

2.3 If you wish to suspend or terminate the authorisation for any authorised person to pick up your child from the preschool centre, you must update such suspension or termination through your SkoolNet 2 Parent App to have the authorised person’s SkoolNet 2 account or any of its services suspended, deactivated or terminated. 

2.4 In the event NFC receives a notification from a parent pursuant to Clause 2.3, you understand and agree that:

  1. NFC may take up to 48 hours to suspend, deactivate or terminate the authorised person’s SkoolNet 2 account and/or any of its services; and
  2. NFC shall not be held responsible for any incident or accident that may occur after an authorised person has picked up your child from the preschool before the authorised person’s SkoolNet 2 account and/or its services has/have been suspended, deactivated or terminated.

3. Privacy and Protection of Personal Information

3.1 Personal data which you provide to us is subject to our Privacy Policy (available at https://www.ntucfirstcampus.com/privacy-policy/), which is incorporated by reference into these T&Cs, and applies to your access and/or use of SkoolNet 2

3.2 By accessing or using SkoolNet 2, you consent to our Privacy Policy and our collection, use, and disclosure of your personal data in accordance with our Privacy Policy”

4. Intellectual Property Rights

4.1 SkoolNet 2 and the content and services (including but not limited to software, files, graphics, and data) made available on SkoolNet 2 are the property of and owned by, licensed to, or controlled by NFC, and are protected by copyright, trademark and other forms of proprietary laws.

4.2 Except as otherwise provided, the content and services made available on SkoolNet 2 shall not be reproduced, republished, uploaded, posted, transmitted, or otherwise distributed in any way (including without limitation downloading event photographs from SkoolNet 2 and publishing, uploading, or posting such photographs on your personal social media account without NFC’s prior written permission).

4.3 You may view, download and print content made available on SkoolNet 2, provided:

  1. you use such content solely for purposes in connection with your child’s attendance at the preschool centre; and
  2. you keep intact all accompanying copyright and proprietary notices.

4.4 All trademarks, service marks and logos displayed in SkoolNet 2 are the property of NFC and third-party proprietors identified in SkoolNet 2.

4.5 You agree not to use any of the trademarks, service marks logos referred to in Clause 4.4 in any manner without the prior written permission of the relevant owner.

5. User Conduct

5.1 In connection with your access or use of SkoolNet 2, you agree:

  1. to act in a responsible, ethical, and legal manner;
  2. not to allow any other persons (including your own child) to access or use your SkoolNet 2 account; 
  3. not to access or use or attempt to access or use any SkoolNet 2 account other than your own SkoolNet 2 account;
  4. not to disclose or share with any other persons (including your own child), your SkoolNet 2 account details (such as your username and password); 
  5. not to access or attempt to access information concerning children other than your own child;
  6. not to use or attempt to use SkoolNet 2 or to encourage the use of SkoolNet 2 for unlawful activities, including but not limited to contravening the Personal Data Protection Act 2012, the Protection from Harassment Act 2014 and any subsidiary legislation promulgated thereunder;
  7. not to upload, post, transmit or otherwise make available on SkoolNet 2, any content which is unlawful, defamatory, abusive, obscene, indecent, lewd, pornographic, violent, threatening, discriminatory, or otherwise objectionable;
  8. not to upload, post, transmit or otherwise make available on SkoolNet 2, any content that you do not have the right to disclose under any law or under contractual or fiduciary relationships (such as insider information, or proprietary and confidential information learned or disclosed under non-disclosure agreements);
  9. not to upload, post, transmit or otherwise make available on SkoolNet 2, any content that infringes upon patents, trademarks, trade secrets, copyrights, rights of publicity or privacy or other proprietary or personal rights (including without limitation photographs of children other than your own child, unless the prior written consent of those children’s parents have been obtained);
  10. not to upload, post, transmit or otherwise make available on SkoolNet 2, any content that is intentionally false, or misleading;
  11. not to upload, post, transmit or otherwise make available on SkoolNet 2, any unsolicited or unauthorised advertising, promotional materials, “junk mail”, “spam”, “chain letters”, “pyramid schemes”, political campaigning or any other form of solicitation;
  12. not to upload, post, transmit or otherwise make available on SkoolNet 2, any content that contains software viruses or any other computer code, files or program designed to interrupt, destroy or limit the functionality of SkoolNet 2 or NFC’s computer software, hardware or telecommunications equipment;
  13. not to interfere with or disrupt SkoolNet 2 or the servers or networks connected to SkoolNet 2, or breach any requirements, procedures, policies or regulations of networks connected to SkoolNet2;
  14. not to use SkoolNet 2 to collect personal information about individuals; 
  15. to be responsible for maintaining the confidentiality of any printed or electronic materials made available on or generated from SkoolNet 2;
  16. to immediately notify NFC of any unauthorised access or use of your SkoolNet 2 account;
  17. to immediately notify NFC if you identify a cybersecurity problem within SkoolNet 2, without demonstrating the problem to any other persons.

6. Monitoring and Enforcement

6.1 NFC reserves the right to monitor all activities on SkoolNet 2 for the purpose of ensuring and enforcing compliance with these Terms and any other applicable laws.

6.2 NFC reserves the right to investigate any violations or alleged violations of these Terms, and may take any action including issuing warnings, and suspending or terminating the relevant SkoolNet 2 account.

7.1 SkoolNet 2 may contain hyperlinks to third-party websites or mobile applications.

7.2 The hyperlinks to third-party websites or mobile applications are provided for your convenience and shall not be construed as NFC’s endorsement of such third-party websites or mobile applications or imply any affiliation or association with such third party.

7.3 As these third-party websites and mobile applications are not under NFC’s control, NFC is not responsible for the information, features, functions, and privacy practices or policies of any of these third-party websites and mobile applications and any hyperlinks contained in these third-party websites and mobile applications.

7.4 You agree that access to any third-party websites and mobile applications through SkoolNet 2 is at your own risk.

8. Accuracy, Completeness and Timeliness of Content and Services

8.1. NFC is not responsible for any content or services that is not accurate, complete or up to date.

8.2 The content, including any historical information, provided on SkoolNet 2 is for general information only and should not be relied upon or used as the basis for making significant decisions without consulting primary or more accurate, more complete, or more timely sources of information. Any reliance on the content provided on SkoolNet 2 is at your own risk.

8.3 SkoolNet 2 may contain information provided by third parties, and the opinions and views of third parties. NFC is not under any obligation to verify the information provided by third parties, and the opinions and views expressed by third parties are not those of NFC and are not endorsed by NFC.

8.4 While NFC reserves the right to modify the contents of SkoolNet 2 at any time, NFC has no obligation to update any information on SkoolNet 2.

9. Disclaimer of Warranties and Liabilities

9.1 The contents made available on SkoolNet 2 are provided on an “as is” basis without warranties of any kind.

9.2 To the fullest extent permitted by applicable laws, NFC does not make any representations or warranties of any kind whatsoever in relation to the contents and services made available on SkoolNet 2, and hereby disclaims all express, statutory and implied warranties:

  1. of any kind as to the accuracy, adequacy, reliability, currency, timeliness, completeness, title, merchantability, quality or fitness for any particular purpose or non-infringement of SkoolNet 2 and its contents and services; and
  2. that SkoolNet 2 and its contents and services will be provided without interruption and error-free, that defects will be corrected, that SkoolNet 2 will be secure, that SkoolNet 2 and the server that makes SkoolNet 2 available is and will be free of all viruses and/or other harmful elements.

9.3 To the fullest extent permitted by applicable laws, NFC and its affiliates, and their officers, directors, employees, contractors, agents, licensors and suppliers, shall not be liable for any damage or loss of any kind whatsoever and howsoever caused, including any direct or indirect, special or consequential damages, loss of income, revenue or profits, any lost or damaged data, any damage to your computer system, mobile phone, software or any other property, whether arising directly or indirectly from your access to or use of SkoolNet 2 (including the download of any content from SkoolNet 2), any loss of access to SkoolNet 2, any inaccuracy or incompleteness, or errors or omissions in the transmission of the contents or services provided by SkoolNet 2, any delay or interruption in the transmission of the contents or services provided by SkoolNet 2, and any action taken by you in reliance upon the contents or services provided by SkoolNet 2.

9.4 Subject only to any liability that cannot be excluded or limited by applicable laws, you agree that in no event shall NFC’s total cumulative damages to you exceed the total amount of fees actually paid by you to NFC during the six months immediately preceding the event which gave rise to your claim or claims, in Singapore Dollars.

10. Indemnification

10.1 You agree to indemnify, defend and hold harmless NFC and its affiliates, and their officers, directors, employees, contractors, agents, licensors and suppliers, from and against any and all losses, liabilities, expenses, damages and costs, including reasonable legal fees and court fees, arising or resulting from any violation of these Terms.

10.2 In the event you cause a technical disruption of SkoolNet 2 or the systems transmitting SkoolNet 2 to you or other persons, you agree to be responsible for any and all losses, liabilities, expenses, damages and costs, including reasonable legal fees and court fees, arising or resulting from that disruption.

11. Governing Law and Jurisdiction

11.1 These Terms and your access and use of SkoolNet 2 are governed by the laws of the Republic of Singapore, without giving effect to any conflict of laws principles that may provide for the application of the laws of another jurisdiction.

11.2 The parties hereto hereby submit to the exclusive jurisdiction of the Singapore courts.

12. General

12.1 If any provision or part-provision of these Terms is or becomes unlawful, void or unenforceable, such provision or part-provision shall be deemed modified to the minimum extent necessary to make it lawful, valid and enforceable.

12.2 If the modification contemplated in Clause 12.1 is not possible, the relevant provision or part-provision shall be deemed deleted.

12.3 Any modification to or deletion of a provision or part-provision under this Clause shall not affect the lawfulness, validity and enforceability of the remaining Terms.

12.4 These Terms, and any other policies or guidelines referenced herein, are the entire agreement and understanding between you and NFC with respect to the access and use of SkoolNet 2 and the contents and services thereof, superseding all prior or contemporaneous communications.

12.5 A printed version of these Terms shall be admissible in judicial or administrative proceedings based on or relating to the access and use of SkoolNet 2 to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
